Indie Developer Says Monster Energy's Legal Claim "Has No Merit" And That It Will "Never" Comply
The energy drink company is suing Glowstick Entertainment because of its game Dark Deception: Monsters & Mortals.

That indie developer currently being sued by Monster Energy refuses to back down.
The energy drink company filed a lawsuit against Glowstick Entertainment because of its game Dark Deception: Monsters & Mortals. Why? Because “monster,” that’s why.
Well, the indie developer’s CEO Vincent Livings won’t kneel. After announcing the plan to take matters to court, Glowstick Entertainment launched a GoFundMe campaign for legal expenses that currently sits at over $20,000 raised. The studio also filed a Motion for Summary Judgement, which could prevent an actual trial.
“It was completely unexpected and it took me a while to believe it was real,” Livings told DualShockers. “At first, I thought it could be an impostor or trademark troll.” He felt Monster Energy was just “over-policing” and that a settlement would be reached in a timely manner.
“I believe their claim has no merit, and we will win if we can make it through the entire legal process,” Livings added. “That’s how they usually win - most of their targets can’t afford it.” He said Glowstick Entertainment will “never” comply with the demands set by the energy drink company on the grounds that nobody has exclusive rights to words like “monster, beast, or unleashed.”
Livings appreciates the support from the gaming community regarding the situation and hopes this battle will inspire others to fight legal claims that bear no weight going forward.
